1.2	By using our website or services, you accept these terms and conditions in full; accordingly, if you do not accept these terms and conditions or any part of these terms and conditions, you must not use our website nor services for any reason.
1.3	If you register with our website, we will ask you to expressly agree to these terms and conditions.
1.4	Midwest Nudists imposes an age restriction on those who can create an account: You must be at least 18 years of age to use our website or services on your own; by using our website or services or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age. If you are under 18 years of age, but not under 13 years of age, you may use our website and services under the supervision of a parent or legal guardian. The parent or legal guardian must be at least 18 years of age and agree to these Terms and Conditions on your behalf. You may only use our website or services through the parent or guardian’s guidance. Furthermore, you may not create an account for your own use until you are at least 18 years of age. If you are under 13 years of age, you may not use our website nor services under any circumstances due to child privacy protection laws.

5.4	You are responsible for the use and access of Midwest Nudists. Please be mindful of your environment when using the website or our services. It is not advised to use or access Midwest Nudists at a location which would not tolerate nudism, especially but not limited to schools, places of employment, or the general public.

Registration and Accounts

6.1	To be eligible for an account on our website under Section 6, you must meet all provisions under Section 1.4.
6.2	You may register for an account with our website by completing and submitting the account registration / join form on our website (which includes accepting the Terms and Conditions and the Privacy Policy), and clicking on the email verification link in the email that the website will send to you. Accounts must also be manually approved by the staff before you can log in.
6.3	You must not allow any other person to use your account to access the website (however, under section 1.4b, you may access our website on behalf of an individual between the age of 13 and 18 years if you are the legal parent or guardian; you may not allow that individual direct control over, or direct access to, your account).
6.4	No one, including staff, may request or solicit the credentials of any other account on Midwest Nudists. If access is necessary to someone’s account due to an issue brought to the staff’s attention, administrators (the highest level of staff) can access an account without needing to know the credentials.
6.5	You must notify us in writing immediately if you become aware of any unauthorized use of your account or if someone, including a staff member, is requesting your account credentials. Please see Section 23 on how to contact us.
6.6	You must not use any other person's account to access the website except under Section 1.4b (you are between the age of 13 and 18 years, and a parent or legal guardian is guiding your use of the website through their account).
6.7	Only one account is permitted per person. Individuals may not register more than one account on Midwest Nudists.
6.8	On the subject of inactive member accounts, defined as accounts which have not been logged in for 12 or more months: Inactive accounts are automatically deleted and the data deleted or anonymized, in accordance with the GDPR. Members are given a notice in an email after the 11th month of inactivity warning them of this automatic process, and again 7 days before the process happens, and again 24 hours before the process happens. This automatic process cannot be prevented or stopped. It ensures we comply with the GDPR.

User Credentials

7.1	If you register for an account with our website, you will be asked to choose a username and password unless you sign up using a third-party account (your username will be the same as on your third-party account, and you will log in through your third-party account instead of using a password on our website).
7.2	Your username must not be liable to mislead and must comply with the Community Guidelines set out in Section 11; you must not use your account or username for or in connection with the impersonation of any person. You may, however, use an otherwise appropriate pseudonym as you are not required to publicly identify yourself.
7.3	Providing you specified a valid email address on your account, you will be emailed when a high-risk detail is changed on your account. A high-risk detail is defined as your username, password, email address, phone number if applicable, or credit card number on file if applicable. If your email address was changed, both the old and the new email address will receive the email. For security, the email will be vague and will provide a masked version of the new value set (except for the password which will not be provided at all in the email).
7.4	You will be emailed if an account was created for you on your behalf. You will also be emailed, subject to Section 7.3, if your account was deleted.
7.5	You must keep your password confidential. Do not share it with anyone, including staff, for any reason.
7.6	You must notify us in writing immediately if you become aware of any disclosure of your password. Please see Section 23 for our contact information. You are responsible for changing your account password and all other accounts you have across the internet using the same or similar password.
7.7	You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.
7.8	You are responsible for any and all activity on our website associated with your IP address even if you were using a TOR browser, proxy, VPN, other IP masking service, or a public internet, and had the misfortune of getting assigned a malicious IP address. You may be held liable for any losses or damages arising from such activity.

Accounts

8.1	We may, at any time in our sole discretion, when we reasonably believe such action will serve the best interests of the community as a whole, with or without notice: ban your account; delete your account; restrict your account’s privileges; report your username, email, or IP address to the Stop Forum Spam service or other spam blacklists; edit your account details; purge or anonymize your data
8.2	You may delete your account on our website at any time and for any reason by going to your account profile, click the edit tab at the top, and click delete on the left. If this does not work, please contact us using a method in Section 23.
8.3	It is unlawful, in accordance with the GDPR, for Midwest Nudists to prevent any member from deleting their own account for any reason, or to reject a user's request to have their account deleted when we have reasonable evidence they are the person who owns the account.
8.4	You understand that deleting your account in accordance with section 8.2 does not automatically delete all of the content you published on Midwest Nudists; such content will be made anonymous. You must contact us through a method described in Section 23 and request to have your data deleted.

Your Content: License

9.1	In these terms and conditions, "your content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that you submit to us or our website for storage or publication on, processing by, or transmission via our website.
9.2	You grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to reproduce, store and, with your specific consent, use or publish your content on and in relation to this website.
9.3	You grant to us the right to sub-license your content under Section 9.2.
9.4	You grant to us the right to bring an action for infringement of the rights licensed under Section 9.2.
9.5	You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.
9.6	You may edit your content to the extent permitted using the editing functionalities made available on our website.
9.7	Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, invalidate (hide), or edit any or all of your content.
9.8	You may request to have a download of your data or to have your data made anonymous / deleted. Please see Section 23 for contact information and send your request using one of those methods. Please also specify if you want your data downloaded, made anonymous, or deleted by account ID, username, e-mail address, and/or IP address. You may be asked a couple of questions to verify your identity.
9.9	In accordance with Section 9.8, You understand that Midwest Nudists is not obligated to delete data necessary to maintain the trust and safety of the website and community. This includes specifically account and IP bans or any information we are legally obliged to maintain for legal investigations or contracts. Moderation and security logs will not be immediately deleted upon request, but they will be anonymized and eventually deleted in accordance with the Privacy Policy.

Identity and Age Verification

10.1	For the safety and integrity of the community, we require those who wish to upload any multimedia, files, or attachments to go through a verification process. The verification process is optional and is handled entirely by Midwest Nudists to ensure the utmost privacy; we do not use any third party identification services.
10.2	The verification process involves taking a picture with the following: your face clearly visible, your valid and active government issued ID visible (which has your photo, date of birth, issue date, expiration date, and any security features visible and legible; all other information may be censored), and a piece of paper visible where you hand-wrote your Midwest Nudists username and a random code given to you on the verification form. All elements must be in the same single photo. The photo must be unmodified except to optionally censor unnecessary information on the government issued ID.
10.3	Those who are not verified will see a nag message at the top of every page. The message will contain a link you must click if you wish to get verified.
10.4	You must follow the instructions as indicated on the verification form, and submit the verification form as instructed, to be verified. A staff member will manually review your request and either approve your verification if it satisfies all requirements, or reject it if it does not.
10.5	You will be contacted by a staff member if your verification request was rejected and the reason for its rejection. You may submit a new verification request unless otherwise told.
10.6	After your verification request is approved, it will remain valid until your government issued ID expires. After that date, you will lose the privilege to upload media, files, and attachments. You will be required to submit a new verification request with your updated government issued ID after that date to re-gain the privilege to upload media and files.
10.7	You may request to have their verification status revoked at any time through the contact methods listed in Section 23 or by deleting your verification record. You will immediately lose the privilege of uploading files, media, and attachments upon revocation.
10.8	No one under these Terms and Conditions, including staff and administrators, are exempt from the requirement to verify to upload files, media, or attachments.
10.9	Staff, or those with the ability to review and approve verification requests, may not review / verify their own verification requests. Another person with the privilege must do so.
10.10	We do not warrant those who complete the verification process are law-abiding citizens who have the best interests of the nudist or Midwest Nudists community. The verification process serves only to ensure those who submit nudist media are 18 years of age or over and are not submitting media which contain other people (unless written consent was otherwise given by all individuals in the photo and Midwest Nudists). If someone does not have the best interests of the community, they should be reported promptly.

Community Guidelines

11.1	You warrant and represent that your content and conduct within Midwest Nudists will comply with these terms and conditions and community guidelines.
11.2	Your content and conduct must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).
11.3	You may not publish content that constitutes an incitement to commit a crime, instructions for the commission of a crime, nor the promotion of criminal activity.
11.4	You may not publish any multimedia to Midwest Nudists containing people regardless of who they are or their state of dress if you have not completed the verification process as explained in Section 10.
11.5	You may not publish any content to our website depicting people under 18 years of age regardless of their consent or state of dress. If said content contains nudity, it will be enforced in accordance with section 11.2 as child pornography even if it was nonsexual in accordance with United States law.
11.6	If your media contains people other than yourself, you must get prior written and documented consent from everyone in the media who meets one or more of the criteria below before you may publish your media to Midwest Nudists: the party, or any other party in the media, is partially or fully nude (e.g. if anyone is partially or fully nude, then you must get consent from everyone in the media regardless of their state of dress), or the party's face is visible either partially or fully, or any identifiable traits of the party are visible, such as a tattoo. The documented consent must indicate the media to which the party consents, such as the file name or a reasonably identifiable description of the media. Consent does not perpetually apply to other media which includes them; consent must be explicitly granted and documented for every medium which they appear and is to be published.
11.7	We operate under the core value that nudism is not sexual. You may have civil and educational discussions on sexuality providing they follow the Terms and Conditions. However, you may not: submit content or conduct yourself in a way that is sexual, obscene, indecent, or oriented to the prurient interests of others; publish media depicting, or express, sexual arousal; publish media depicting, or express, excessive Public Displays of Affection (PDA); appropriate nudism with sex.
11.8	You may not make any crude comments about someone’s body or appearance.
11.9	You may not solicit others for dating, sex, personal information or media, or any content or conduct that would violate the Terms and Conditions regardless of their consent.
11.10	You may not harass others. Harassment is defined as making repeated and unwanted actions towards someone else.
11.11	You may not publish nor spread content on our website which is libellous, maliciously false, or misleading.
11.12	You may not publish content that infringes any copyright, moral rights, database rights, trade mark rights, design rights, right in passing off, or other intellectual property rights.
11.13	You may not publish content that infringes any right of confidence, right of privacy or right under data protection legislation.
11.14	You may not provide negligent advice nor publish any negligent statements.
11.15	You may not publish content that would be in contempt of any court, or in breach of any court order.
11.16	You may not publish content nor conduct yourself in a way that would be in breach of minority hatred or discrimination legislation.
11.17	You may not publish content that would be in breach of official secrets legislation.
11.18	You may not publish content that would be in breach of any contractual obligation owed to any person.
11.19	You may not publish content containing violence, gore, abuse, neglect, or personal harm.
11.20	You may not promote the consumption, purchase, or participation in, drugs (including prescription drugs), alcohol, tobacco (including e-cigarettes), weapons, gambling, or products made from endangered species, without the prior written and documented permission of Midwest Nudists. Discussion of such topics without promoting them is permissible.
11.21	You are responsible for the accuracy of all content you publish. You may not publish content that is inaccurate, false, or misleading.
11.22	You may not publish content that consists of or contains any instructions, advice or other information which may be acted upon and could, if acted upon, cause mental frustration, illness, injury or death, or any other loss or damage on others.
11.23	You may not publish content nor conduct yourself in a manner that is offensive, deceptive, fraudulent, threatening, abusive, harassing, menacing, hateful, prejudiced or inflammatory.
11.24	You may not intentionally or recklessly cause needless anxiety to any person.
11.25	You may not publish content in an irrelevant section of the website.
11.26	You may not publish content nor conduct yourself in a manner that is spam, trolling, or unwanted. This includes advertising which did not go through an official channel (such as getting documented approval to advertise from Midwest Nudists, or making a purchase to advertise through the store or classifieds).
11.27	You may not re-publish any content on the website or from emails sent by Midwest Nudists to another location on the website without the prior written and documented permission of Midwest Nudists; content may have specific privacy settings and are not meant to be viewed by anyone outside those settings. Sharing links to such content is permitted.
11.28	You may not use non-ASCII characters (such as Zalgo characters or wingdings) in your content.
11.29	You may not use forum signatures that are visually disruptive or disrupt the layout or design of the page.
11.30	You may not engage in, nor harass or coerce members into, activities with other members that are not consensual. And you must cease the activity immediately without harassment if consent is later revoked. For the purpose of investigation, a lack of written and documented consent from someone is the same as never having been given consent.
11.31	You must enclose spoilers for movies, games, events, television shows, or other copyrighted works in a Comcode hide tag: [hide]Example spoiler content[/hide].
11.32	You may not use our website or services for professional, legal, or medical advice. Be responsible with any advice you receive from others.
11.33	You must use the English language at all times for moderation purposes.
11.34	When sending a member a Private Topic, if you are presented with Private Topic guidelines, you must abide by all guidelines as written unless doing so would violate the Terms and Conditions.
11.35	When entering a forum or topic, if presented with additional guidelines or rules, you must abide by all guidelines and rules as written unless doing so would violate the Terms and Conditions.
11.36	On the subject of member karma: The karma of members are an experimental measure of one’s reputation and trust in the community. Karma is represented as good and bad relative to each other. Karma considers many factors including a member’s Terms and Conditions violations, feedback / ratings received on their content, content awards (features), points received from other members, virtual gifts received, and level of activity in the community. Typically, the higher a member’s good karma and the lower a member's bad karma, the more established they are in Midwest Nudists and the less likely they are to cause trouble.  You may not harass or bully members regarding their karma. You may not exploit website features for the purpose of affecting a member’s karma without good reason (such as but not limited to submitting mindless or false ratings, giving members points or virtual gifts for a reason other than rewarding them for positively impacting the community in some way, or reporting a member’s content when it does not violate the Terms and Conditions).
11.37	You may not expose the personal or identifiable information of other members (such as but not limited to first / last names, addresses / locations, phone numbers / contact information, IP addresses, account credentials, private content, credit card numbers, social security numbers, any form of ID number, wealth / economic / income status, health / medical information, classified information, other accounts they use online). Any information a member is willing to share shall, and only shall be, shared by them at their own risk.
11.38	When reasonably able to do so, you must use the appropriate “Report This” link or “Report” button when reporting something that is in violation of the Terms and Conditions. If you are not reasonably able to do so, you may use a Support Ticket or email and include unaltered screenshots of the problematic content. See Section 23 for contact information.
11.39	Midwest Nudists is not obligated to take responsibility for any content or conduct that takes place outside of our website and services. To ensure your safety, we recommend you contain your correspondence with other members on our website (through Private Topics, the forums, etc).
11.40	You may not exploit any of the rewards systems used on Midwest Nudists in a manner which is detrimental to the community, such as but not limited to submitting fake ratings, spamming virtual gifts or points, adding members as a friend with no reasonable intention, or posting content for the sole purpose of earning points.
11.41	On the subject of submitting content to Midwest Nudists containing any transformations or generations made by an Artificial Intelligence (AI): You must responsibly disclose the use of AI in any and all related content. You must also credit the websites or AI models used. Content where AI was utilized must also contain original transformations made by the submitter which did not utilize AI. AI content submitted to Midwest Nudists must be kept to a minimum; a majority of your recently submitted content must be original and not utilize AI. In accordance with U.S. copyright law, content utilizing AI cannot be copyrighted. As such, all sections of the Terms granting protections for Intellectual Property and copyright do not apply to content which utilized AI; you do not own any content which utilized AI. Furthermore, within Midwest Nudists, all content utilizing AI is Public Domain.

Goods and Services

12.1	Midwest Nudists has a few paid services offered such as but not limited to advertising. The purpose of these paid services are to assist with the expenses of running the website and services. Midwest Nudists has no intention of profiting; excess funds received will be held for emergency use or donated to nudist-friendly organizations and causes.
12.2	You agree to provide payment for goods and services you purchase by the date and time they are due.
12.3	Midwest Nudists reserves the right to suspend or cancel services, or to charge late fees, for payments not made on time.
12.4	Members are entitled to a 30-day refund period. Should a product or service blatantly violate the Terms and Conditions or is otherwise defective beyond a member’s ability to use as advertised, members may contact Midwest Nudists within 30 days of purchase for a full refund.
12.5	Midwest Nudists has a virtual currency system called “points”. Points have no monetary value outside of the Midwest Nudists website and cannot be traded in for legal tender currency. However, they can be used for acquiring certain features, obtaining discounts, rewarding others, increasing one’s voting power in forum polls, and “escrowing” others for their personal services on or outside Midwest Nudists.
12.6	When purchasing something, if presented with additional Terms specific to that item, by proceeding with the transaction, you agree to the Terms and Conditions of purchasing that item in full, excluding any provisions that directly violate these Terms and Conditions.
12.7	Some downloads may require agreement to a licence. When downloading a file, you agree to the Terms and Conditions of the stated licence except for provisions that violate these Terms and Conditions.

Limitations of Warranties

13.1	We do not warrant or represent: the completeness or accuracy of the information published on our website; that the material on the website is up to date; or that the website or any service on the website will remain available.
13.2	We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.
13.3	To the maximum extent permitted by applicable law and subject to Section 13.1, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our website and the use of our website.
13.4	To the maximum extent permitted by applicable law and subject to Section 13.1, we exclude all representations and warranties relating to the views and opinions expressed on our website or about our website.

Limitations and Exclusions of Liability

14.1	Nothing in these terms and conditions will: limit or exclude any liability for death or personal injury resulting from negligence; limit or exclude any liability for fraud or fraudulent misrepresentation; limit any liabilities in any way that is not permitted under applicable law; or exclude any liabilities that may not be excluded under applicable law.
14.2	The limitations and exclusions of liability set out in this Section 14 and elsewhere in these terms and conditions:  are subject to Section 14.1; and govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
14.3	To the extent that our website and the information and services on our website are provided free of charge, we will not be liable for any loss or damage of any nature.
14.4	We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
14.5	We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
14.6	We will not be liable to you in respect of any loss or corruption of any data, database or software.
14.7	We will not be liable to you in respect of any special, indirect or consequential loss or damage.
14.8	We will not be liable to you in respect of any loss or damage resulting from others’ knowledge of your use of our website or services unless we are directly responsible for them having obtained that knowledge.

Violations of the Terms and Conditions

15.1	Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect with clear and convincing evidence that you have breached these terms and conditions in any way, we may:  send notices of violations in your Private Topics / emails; assign bad karma on your profile; edit or delete the offending content; restrict your privileges temporarily or permanently; ban your account and/or IP address; charge points or take away awards from your account; report you to spam blacklists such as Stop Forum Spam or Tornevall; file a police report with local authorities if criminal activity is suspected; investigate the contents of your account, including Private Topics.
15.2	Where we suspend or prohibit or block your access to our website or a part of our website, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account or IP address).
15.3	Where we take any action described in Section 15.1 resulting from a violation of the Terms and Conditions, you have the right to file an appeal should you feel your violation does not warrant the actions taken against you: You must file your appeal within 7 days of the actions being performed using a contact method in Section 23; you may not contact staff directly. Your appeal message must include clear and convincing justification as to why your violation does not justify the actions performed against you; apologies are not acceptable appeals. Your appeal message must be civil and respectful.
15.4	Midwest Nudists has the right, but not the obligation, to enforce violations of the Terms and Conditions using the methods outlined in Section 15.1 which occurred outside of the site or services. Staff must reasonably believe such violation jeopardizes the safety, security, or integrity of Midwest Nudists or the nudist community.

Revisions

16.1	We may revise these Terms and Conditions or the Privacy Policy from time to time as we deem necessary.
16.2	We will give you written notice of any revision of these Terms and Conditions or Privacy Policy through email and as a news posting on the site, and the revised Terms and Conditions or Privacy Policy will apply to the use of our website from the date that we send out such notice; if you do not agree to the revised Terms and Conditions or Privacy Policy, you must stop using our website and services and delete your account immediately.
16.3	When the revised Terms and Conditions or Privacy Policy goes in effect, your continued use of the website and services implies acceptance of the revisions in full.

Assignment of Rights and Obligations

17.1	You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
17.2	You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.

Severability

18.1	If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other lawful and enforceable provisions will continue in effect.
18.2	If any unlawful and/or unenforceable provision of these Terms and Conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Third-Party Rights

19.1	A contract under these Terms and Conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.
19.2	The exercise of the parties' rights under a contract under these Terms and Conditions is not subject to the consent of any third party.

Entire Agreement

Subject to Section 14.1, these Terms and Conditions, together with our Privacy Policy, shall constitute the entire agreement between you and us in relation to your use of our website and shall supersede all previous agreements between you and us in relation to your use of our website.

Law and Jurisdiction

21.1	These terms and conditions shall be governed by and construed in accordance with United States (federal) and Ohio (state) law.
21.2	Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United States and the courts of the State of Ohio.

22.2	Midwest Nudists is currently owned and operated by PDStig, LLC.
